Impossibilidade de Cobrança e o dever de Reembolso da Taxa de Incêndio (Funesbom) por Decisão do STF

Todos os anos, é comum que os proprietários de imóveis e locatários recebam os boletos de taxa de incêndio (Funesbom) como débito cobrado pelo estado do Rio de Janeiro para fins de custear o reequipamento do Corpo de Bombeiros, nas áreas de salvamento e combate e prevenção de incêndio. 

Contudo, em decisão reiteradas, o Supremo Tribunal Federal (STF) não só estabeleceu que a cobrança de taxa de incidêncio pelos estados é ilegal, não podendo ser exigida dos proprietários de imóvel, como também determinou a devolução dos valores cobrados nos últimos 05 (cinco) anos. 

Em caso recente, datado de agosto de 2020, a Suprema Corte declarou a inconstitucionalidade da lei do Estado de Minas Gerais, que determinava a cobrança de taxa de incêndio, motivando a decisão com base no entendimento de que o combate a incêndios é um serviço público geral e, consequentemente, não pode ser exigido o pagamento de uma taxa com esta finaldiade. 

Embora a lei do estado do Rio de Janeiro ainda não tenha sido objeto de análise do Supremo, diversas empresas e proprietários de imóveis têm procurado o Poder Judiciário para anular a cobrança desta taxa e diminuir os custos que recaem sobre seus imóveis, oportunidade na qual alguns têm obtido êxito com o ingresso de ações, ora fundamentadas no entendimento fixado reiteradamente pelo Supremo. 

Portanto, diante dos julgamentos do STF acerca da inconstitucionalidade da taxa de incêndio, tem-se uma oportunidade para que as empresas e/ou as pessoas físicas diminuam os custos que recaem sobre seus imóveis, o que pode ser feito mediante ingresso de ação judicial, de forma a solicitar a nulidade de cobranças futuras da taxa de incêndio, bem como o reembolso das taxas nos últimos 05 (cinco) anos.

 

Every year, it is common for property owners and tenants to receive fire tax splis (Funesbom) as debit charged by the state of Rio de Janeiro for the purpose of defraying the re-equipment of the Fire Department, in rescue and rescue areas fire fighting and prevention. 

However, in a repeated decision, the Federal Supreme Court (STF) not only established that the charging of the tax rate by the states is illegal and cannot be demanded from property owners, but also determined the return of amounts collected in the last 05 (five) years old. 

In a recent case, dated August 2020, the Supreme Court declared the unconstitutionality of the law of the State of Minas Gerais, which determined the collection of a fire fee, motivating the decision based on the understanding that firefighting is a public service and, consequently, a fee cannot be requerid for this purpose. 

Although the law of the state of Rio de Janeiro has not yet been analyzed by the Supreme Court, several companies and property owners have sought the Judiciary to cancel the collection of this fee and reduce the costs that fall on their properties, an opportunity in which some have been successful with the filing of lawsuits, now based on the understanding set repeatedly by the Supreme. 

Therefore, given the STF judgments about the unconstitutionality of the fire rate, there is an opportunity for companies and/or individuals to reduce the costs that fall on their properties, which can be done by filing a lawsuit, in order to request the nullity of future charges of the fire fee, as well as the reimbursement of fees in the last 05 (five) years.
