Autonomia da vontade como paradigma das novas relações de trabalho

Autonomy of will as paradigm of new work relations

Com a entrada em vigor da lei 13.467/2017, ora conhecida como "reforma trabalhista", tem-se a mudança de paradigma do modelo estrutural trabalhista, que existia com base na aplicação quase absoluta do princípio da proteção do trabalhador, e a ampliação da autonomia da vontade, de modo que empregado e empregador passam a poder negociar individualmente sobre diversos temas.

Como expoente principal desse avanço da autonomia da vontade nos contratos de trabalho, tem-se a liberdade de contratação trazida pelo art. 444, parágrafo único da CLT, o qual criou um modelo de contrato de trabalho com livre estipulação de cláusulas entre empregado e empregador, com a mesma eficácia de lei e preponderância sobre acordos e convenções coletivas.

A partir do dispositivo mencionado, surgiu a figura do "empregado hiperssuficiente", o qual pode negociar diretamente com seu empregador sobre as hipóteses previstas no art. 611-A da CLT - jornada de trabalho, horas extras, banco de horas, troca do dia do feriado, etc. -, desde que tenha diploma de ensino superior e perceba salário mensal igual ou superior a 2 vezes o limite máximo do Regime Geral da Previdência Social, o que perfaz atualmente cerca de R$ 12.202,122.

Na prática, a legislação trabalhista passa a ter simultaneamente duas figuras de empregado: o empregado hipossuficiente, que depende da atuação sindical para negociar com o empregador sobre os temas elencados no art. 611-A da CLT; e o empregado hiperssuficiente, que pode negociar diretamente com o empregador as hipóteses trazidas pelo art. 611-A da CLT.

Certo é que, embora grande parte das relações de emprego sejam caracterizadas pelos requisitos da pessoalidade, subordinação jurídica, onerosidade e habitualidade, ao passar dos anos esses pilares vêm sendo mitigados pelos novos modelos de trabalho, nos quais o empregador não possui mais tanto controle para subordinar o empregado a um contrato de trabalho inflexível, razão pela qual se começa a repensar a posição de hipossuficiência e vulnerabilidade do empregado.

Um exemplo clássico disso são aqueles empregados que exercem cargo de gestão dentro de determinada empresa, uma vez que o empregador não controla sua jornada, bem como o empregado não está subordinado ao empregador, visto que as atribuições de fiscalização, mando, admissão e representação o colocam em posição de equilíbrio com o empregador, com condições de negociar.

Outro exemplo claro e amplamente aplicado durante a pandemia do covid-19 é o teletrabalho, no qual o empregado passa a exercer os serviços preponderantemente fora das dependências do empregador, com a utilização de tecnologias de informação e de comunicação, sem o controle de jornada.

A verdade é que o instituto do teletrabalho quebra as ideias tradicionais de habitualidade e subordinação, uma vez que o empregado não presta o serviço de forma contínua, bem como, muitas vezes, o empregador não tem condições de dirigir e fiscalizar a prestação do serviço pelo empregado, o qual passa apenas a receber as tarefas e entregar o resultado para o empregador.

A partir disso, a autonomia da vontade aparece naturalmente para reger esse novo modelo, que não se enquadra na relação comum empregado-empregador prevista nos artigos 2º e 3º da CLT , como pode se observar do art. 75-C, §1º da CLT, que prevê que "poderá ser realizada a alteração entre regime presencial e de teletrabalho desde que haja mútuo acordo entre as partes, registrado em aditivo contratual".

Outrossim, o art. 75-D da CLT ratifica a possibilidade de negociação, haja vista que possibilita ao empregado e ao empregador disporem sobre a responsabilidade pela aquisição, manutenção ou fornecimento dos equipamentos tecnológicos e da infraestrutura necessária e adequada à prestação do trabalho remoto, bem como eventual reembolso de despesas arcadas pelo empregado.

Ato contínuo, cabe analisar o instituto do contrato de trabalho intermitente, modelo de trabalho no qual também se verifica a mitigação dos requisitos do vínculo de emprego atinente à habitualidade, na medida em que o empregado não presta serviço de forma contínua, mas varia entre períodos de atividade e inatividade, motivo pelo qual o empregado receberá apenas pelo período da prestação de serviços.

Certo é que no contrato intermitente também pode se visualizar a autonomia da vontade, posto que o empregado tem a opção de aceitar ou não a oferta de prestação de serviços, bem como poderá optar por prestar serviços a outros contratantes durante o período de inatividade, conforme se depreende do art. 452-A, §2º e §5º, da CLT.

Além disso, o art. 442-B veio formalizar a contratação de autônomos e afastar o risco de configuração de vínculo de emprego, na medida em que estabeleceu que as empresas podem celebrar contratos com autônomos, com ou sem exclusividade, de forma contínua ou não, sem que o contratado possua a qualidade de empregado.

Outrossim, a reforma trabalhista trouxe a possibilidade de instauração de banco de horas por acordo individual entre empregado e empregador, o que antes dependia de negociação entre empresa e sindicato, criando-se um regime de compensação de horas extras sem acréscimo salarial, desde que eventuais horas extraordinárias realizadas pelo empregado sejam gozadas dentro de 6 (seis) meses, conforme art. 59, 5º, da CLT.

A verdade é que os novos modelos de trabalho têm cada vez mais se afastado do conceito de empregado previsto no art. 3º da CLT, oportunidade na qual a autonomia da vontade aparece como forma alternativa para apresentar respostas que a legislação trabalhista de 1943 não oferece, já que se encontra centrada na tradicional forma de relação empregatícia.

Revela-se pouco razoável considerar que profissões de natureza intelectual, literária, artística, técnico-artística, da tecnologia da informação (TI); das ocupações regulamentadas de nível superior; ou mesmo das funções gestoras que mobilizam diferentes linhas de especialidade ou formação universitária, possuem igual grau de subordinação e vulnerabilidade quando comparados aos empregados tradicionais, ora caracterizados no art. 3º da CLT.

Fato é que a sociedade caminha para a formação de um mercado de trabalho composto por trabalhadores "ultraqualificados" e com "superespecialidades", os quais não encontram garantias e regulamentação nas regras existentes na atual legislação trabalhista brasileira, não restando alternativa senão se socorrer dos modelos autônomos, os quais possibilitam a negociação de cláusulas e condições não abarcadas pela CLT.

Em busca da modernização e de soluções alternativas, a reforma trabalhista e as normas editadas durante a pandemia do covid-193 - acordo de redução proporcional de jornada e salário, e acordo de suspensão temporária do contrato de trabalho - quebraram paradigmas, no sentido de ampliar a negociação individual de cláusulas entre empregado e empregador, enquanto anteriormente esse recurso era majoritariamente destinado às entidades sindicais por meio da negociação coletiva.

Portanto, a autonomia da vontade vem crescendo como meio para regular modelos de trabalho que a legislação trabalhista emoldurada em 1943 não é capaz de atender completamente, sendo certo que essa autonomia não se encontra presente apenas para o empregado hiperssuficiente, mas também pode englobar outros empregados, a depender das nuances do modelo de trabalho pactuado entre empregado e empregador.

With the entry into force of Law 13.467 / 2017, known as "labor reform", there is a paradigm shift in the structural labor model, which existed based on the almost absolute application of the principle of worker protection, and the expansion of autonomy of will, so that employees and employers are able to negotiate individually on different topics.

As the main exponent of this advance in the autonomy of the will in employment contracts, there is the freedom of contracting brought by art. 444, single paragraph of CLT, which created a model employment contract with free stipulation of clauses between employee and employer, with the same effectiveness of law and preponderance over collective agreements and conventions.

From the aforementioned device, the figure of the "hypersufficient employee" emerged, who can negotiate directly with his employer on the hypotheses provided for in art. 611-A from CLT - working hours, overtime, hour bank, holiday exchange, etc. - as long as he has a higher education diploma and receives a monthly salary equal to or higher than 2 times the maximum limit of the General Social Security Regime, which currently amounts to approximately R$ 12,202,122.

In practice, labor legislation now has two employee figures simultaneously: the low-income employee, who depends on union action to negotiate with the employer on the topics listed in art. 611-A of the CLT; and the hypersufficient employee, who can negotiate directly with the employer the hypotheses brought by art. 611-A of the CLT.

What is certain is that, although a large part of employment relationships are characterized by the requirements of personality, legal subordination, burdens and habituality, over the years these pillars have been mitigated by new work models, in which the employer no longer has as much control to subordinate the employee to an inflexible employment contract, which is why one begins to rethink the employee`s position of under-sufficiency and vulnerability.

A classic example of this are those employees who exercise a management position within a certain company, since the employer does not control their journey, as well as the employee is not subordinate to the employer, since the supervisory, command, admission and representation duties put them in a balanced position with the employer, able to negotiate.

Another clear and widely applied example during the covid-19 pandemic is teleworking, in which the employee starts to perform services predominantly outside the employer`s premises, using information and communication technologies, without the control of working hours.

The truth is that the teleworking institute breaks the traditional ideas of habituality and subordination, since the employee does not provide the service continuously, and, many times, the employer is unable to direct and supervise the provision of the service by the employee, who will only receive the tasks and deliver the result to the employer.

From this, the autonomy of the will appears naturally to govern this new model, which does not fit into the common employee-employer relationship provided for in articles 2 and 3 of the CLT, as can be seen from art. 75-C, §1 of the CLT, which provides that "the change between face-to-face and telecommuting arrangements may be made provided that there is a mutual agreement between the parties, registered as a contractual amendment".

Furthermore, art. 75-D of CLT ratifies the possibility of negotiation, given that it allows the employee and the employer to dispose of the responsibility for the acquisition, maintenance or supply of technological equipment and the necessary and adequate infrastructure for the provision of remote work, as well as eventual reimbursement of expenses borne by the employee.

Continuous act, it is necessary to analyze the institute of the intermittent employment contract, a work model in which there is also a mitigation of the requirements of the employment bond related to habituality, as the employee does not provide service on a continuous basis, but varies between periods activity and inactivity, which is why the employee will receive only for the period of service provision.

What is certain is that in the intermittent contract you can also see the autonomy of the will, since the employee has the option of accepting or not offering the service provision, as well as being able to choose to provide services to other contractors during the period of inactivity, as it follows from art. 452-A, §2 and §5 of the CLT.

In addition, art. 442-B came to formalize the hiring of self-employed workers and remove the risk of setting up an employment relationship, as it established that companies can enter into contracts with self-employed workers, with or without exclusivity, continuously or not, without the contractor having any employee quality.

Furthermore, the labor reform brought the possibility of establishing an hour bank by individual agreement between employee and employer, which previously depended on negotiation between company and union, creating an overtime compensation regime without salary increase, as long as possible overtime hours performed by the employee are taken within 6 (six) months, according to art. 59, 5º, of the CLT.

The truth is that the new work models have increasingly moved away from the concept of employee provided for in art. 3rd of the CLT, an opportunity in which the autonomy of the will appears as an alternative way to present answers that the labor legislation of 1943 does not offer, since it is centered on the traditional form of employment relationship.

It is unreasonable to consider that professions of an intellectual, literary, artistic, technical-artistic nature, of information technology (IT); regulated higher-level occupations; or even the management functions that mobilize different lines of specialty or university education, have an equal degree of subordination and vulnerability when compared to traditional employees, now characterized in art. 3rd of the CLT.

The fact is that society is moving towards the formation of a labor market composed of "ultra-qualified" workers with "super specialties", who do not find guarantees and regulations in the rules existing in the current Brazilian labor legislation, leaving no alternative but to use the models autonomous, which make it possible to negotiate terms and conditions not covered by CLT.

In search of modernization and alternative solutions, the labor reform and the rules issued during the covid-193 pandemic - agreement of proportional reduction of hours and wages, and agreement of temporary suspension of the employment contract - broke paradigms, in the sense of expanding the individual negotiation of clauses between the employee and the employer, whereas previously this resource was mostly destined to union entities through collective bargaining.

Therefore, the autonomy of the will has been growing as a means to regulate work models that the labor legislation framed in 1943 is not able to fully meet, being certain that this autonomy is not only present for the hypersufficient employee, but can also include other employees , depending on the nuances of the work model agreed between employee and employer.
