IMPLICAÇÕES NO PAGAMENTO DA DOBRA PELAS EMPRESAS DE PETRÓLEO E GÁS

IMPLICAÇÕES NO PAGAMENTO DA DOBRA PELAS EMPRESAS DE PETRÓLEO E GÁS

No dia 19 de março de 2020, a Petrobras editou uma circular no sentido de estabelecer novas medidas em plataformas para prevenção do coronavírus mediante a redução da circulação de pessoas, oportunidade na qual estabeleceu escala especial para as equipes que continuarão embarcando, aplicando isolamento prévio de 07 dias em hotel, e estendendo os dias de embarque para 21 dias a bordo e 14 dias de folga.

Contudo, a Lei 5.811/72, que trata especificamente do trabalho de empregados em atividades do setor de petróleo e gás, especificamente prevê que o empregado não pode realizar escala de revezamento superior a 15 (quinze) dias, conforme se observa abaixo:

Art. 8º O empregado não poderá permanecer em serviço, no regime de revezamento previsto para as situações especiais de que tratam as alíneas A e B do § 1º do art. 2º, nem no regime estabelecido no art. 5º, por período superior a 15 (quinze) dias consecutivos.

Ato contínuo, da referida lei se depreende que, em caso de necessidade operacional e/ou segurança industrial, a empresa somente poderia estender os dias a bordo do empregado se realizasse o pagamento em dobro dos dias em que o empregado permaneceu embarcado além dos 15 (quinze) dias, o que é conhecido usualmente como dobra, senão vejamos:

Art. 2º Sempre que for imprescindível à continuidade operacional, o empregado será mantido em seu posto de trabalho em regime de revezamento.

§ 2º Para garantir a normalidade das operações ou para atender a imperativos de segurança industrial, poderá ser exigida, mediante o pagamento previsto no item II do art. 3º, a disponibilidade do empregado no local de trabalho ou nas suas proximidades, durante o intervalo destinado a repouso e alimentação.

Art. 3º Durante o período em que o empregado permanecer no regime de revezamento em turno de 8 (oito) horas, ser-lhe-ão assegurados os seguintes direitos:

II - Pagamento em dobro da hora de repouso e alimentação suprimida nos termos do § 2º do art. 2º;

Portanto, como regra geral, a dobra deve ser paga pela empresa quando o empregado permanecer a bordo além dos dias de escala normal, posto que a legislação entende que as folgas do empregado foram suprimidas quando este continuou embarcado por mais tempo do que o originariamente pactuado.

Outrossim, na prática, geralmente o acordo coletivo, ora celebrado entre o sindicato da categoria profissional e a empresa, regulamentam os casos de pagamento de dobra, de modo a indicar que para cada 01 (um) dia de embarque, o empregado possui 02 (dois) dias de folga, os quais devem ser gozados ou pagos pela empresa.

Entretanto, considerando o advento da pandemia do coronavírus e a decretação de estado de calamidade pública, o Governo Federal editou a Medida Provisória nº 927/2020 para autorizar a utilização de medidas trabalhistas de enfrentamento, permitindo a flexibilização das relações de trabalho como forma de tentar garantir a manutenção dos empregos.

A partir disso, o art. 2º da Medida Provisória 927/2020, transcrito abaixo, possibilitou às empresas, mediante celebração de acordo individual, pactuar que um período de embarque superior ao limite de 15 (quinze) dias não gerará direito ao pagamento de dobra, valendo essa disposição sobre a lei 5.811/1972, bem como sobre eventual instrumento coletivo outrora celebrado.

Art. 2º  Durante o estado de calamidade pública a que se refere o art. 1º, o empregado e o empregador poderão celebrar acordo individual escrito, a fim de garantir a permanência do vínculo empregatício, que terá preponderância sobre os demais instrumentos normativos, legais e negociais, respeitados os limites estabelecidos na Constituição.

Embora as relações de trabalho regidas pela lei 5.811/1972 não estejam expressamente previstas como hipótese de aplicação da medida provisória mencionada, certo é que não se afasta a possibilidade de celebração de acordo individual para esse caso, haja vista que os empregados do setor de óleo e gás possuem seus contratos de trabalho regulamentados sob a diretriz principal da CLT, sendo a lei 5.811/72 apenas um instrumento utilizado para tratar das especificidades dos trabalhos executados na atividade petrolífera, sobre as quais a CLT, como conjunto de normas gerais, é omissa. 

Portanto, conclui-se que a MP 927 é aplicável aos contratos de trabalho que são regidos pelas peculiaridades da lei 5.811/72, bastando, para tanto, compatibilizar as disposições da medida provisória com a lei dos petroleiros, o que é plenamente possível quando se utiliza a celebração do acordo individual para atender medidas de segurança e saúde. 

Nesse interim, como se trata de medida temporária, revela-se pouco razoável e excessivo exigir que as empresas realizem o pagamento de dobra a partir do 16º dia de embarque, quando a medida provisória 927/2020 busca justamente estabelecer alternativas para as empresas manterem seus empregados.

No entanto, apesar da MP 927/2020 ter estabelecido uma interessante alternativa para as empresas negociarem diretamente com seus empregados durante o estado de calamidade pública, verifica-se que não houve a conversão da medida em lei pelo Congresso Nacional, razão pela qual  a autorização para celebração de acordo individual, com prevalência sobre a lei e sobre instrumentos coletivos, perdeu a vigência no dia 19 de julho de 2020.

A partir disso, considerando a continuidade da crise econômica decorrente das medidas de isolamento social, necessário se revela aguardar o posicionamento do Senado Federal, com a edição de decreto legislativo, a fim de verificar como ficará a validade das disposições e das alternativas trabalhistas criadas pela MP 927/2020.

Portanto, no cenário atual, tem-se como mais seguro para as empresas procurar a negociação de condições específicas perante os sindicatos da categoria profissional, haja vista que o acordo coletivo possui prevalência sobre a lei independentemente da vigência da MP 927/2020, por força do art. 611-A da CLT.

Por fim, é importante ter em mente que qualquer acordo que venha substituir a lei, embora excepcional nas circunstâncias, deve ser manejado por tempo determinado, enquanto permanecer a conjuntura de calamidade pública, devendo ser devidamente justificado e formalizado mediante a celebração de acordo escrito.

 

 

IMPLICATIONS IN THE PAYMENT OF THE DOBRA BY OIL AND GAS COMPANIES

On March 19, 2020, Petrobras issued a circular to establish new measures on platforms for the prevention of coronavirus by reducing the circulation of people, an opportunity in which it established a special scale for the teams that will continue to board, applying prior isolation of 07 days in hotel, and extending the boarding days to 21 days on board and 14 days off.

However, Law 5,811 / 72, which specifically deals with the work of employees in activities in the oil and gas sector, specifically provides that the employee cannot perform a relay schedule exceeding 15 (fifteen) days, as noted below:

Art. 8 The employee may not remain in service, in the rotation regime provided for the special situations referred to in paragraphs A and B of § 1 of art. 2, even in the regime established in art. 5, for a period of more than 15 (fifteen) consecutive days.

It follows from the aforementioned law that, in the event of operational need and / or industrial safety, the company could only extend the days on board the employee if it paid twice as much as the days on which the employee remained on board beyond 15 ( fifteen) days, what is usually known as fold, as we see:

Art. 2 Whenever it is essential for operational continuity, the employee will be kept in his / her job in rotation.

§ 2 To guarantee the normality of operations or to meet the requirements of industrial security, it may be required, upon payment provided for in item II of art. 3rd, the availability of the employee at or near the workplace, during the break for rest and food.

Art. 3 During the period in which the employee remains in the 8 (eight) hour shift rotation regime, the following rights will be guaranteed:

II - Payment in double the hour of rest and suppressed food under the terms of § 2 of art. 2nd;

Therefore, as a general rule, the fold must be paid by the company when the employee remains on board beyond the normal stopover days, since the legislation considers that the employee`s time off was suppressed when the employee remained on board for longer than the originally agreed.

Furthermore, in practice, generally the collective agreement, now celebrated between the union of the professional category and the company, regulates the cases of payment of double, in order to indicate that for each 01 (one) day of departure, the employee has 02 (two) days off, which must be taken or paid by the company.

However, considering the advent of the coronavirus pandemic and the decree of a state of public calamity, the Federal Government issued Provisional Measure No. 927/2020 to authorize the use of labor coping measures, allowing the flexibility of labor relations as a way of trying ensure that jobs are maintained.

Art. 2 of Provisional Measure 927/2020, transcribed below, made it possible for companies, upon conclusion of an individual agreement, to agree that a period of shipment exceeding the 15 (fifteen) day limit will not generate the right to the payment of a double, and Law 5.811 / 1972, as well as on any collective instrument previously celebrated.

Art. 2 During the state of public calamity referred to in art. 1, the employee and the employer may enter into an individual written agreement, in order to guarantee the permanence of the employment relationship, which will prevail over the other normative, legal and business instruments, respecting the limits established in the Constitution.

Although the labor relations governed by Law 5,811 / 1972 are not expressly provided for as a hypothesis for the application of the aforementioned provisional measure, it is certain that the possibility of entering into an individual agreement for this case does not rule out, given that the employees of the oil sector and gas have their labor contracts regulated under the main CLT guideline, the law 5.811 / 72 being only an instrument used to deal with the specificities of the works performed in the oil activity, on which CLT, as a set of general rules, is silent .

Therefore, it is concluded that MP 927 is applicable to employment contracts that are governed by the peculiarities of Law 5.811 / 72, just to make the provisions of the provisional measure compatible with the oil tankers law, which is fully possible when uses the signing of the individual agreement to meet health and safety measures.

In the meantime, as it is a temporary measure, it proves to be unreasonable and excessive to demand that companies pay the double payment from the 16th day of departure, when provisional measure 927/2020 seeks precisely to establish alternatives for companies retain their employees.

However, despite MP 927/2020 having established an interesting alternative for companies to negotiate directly with their employees during the state of public calamity, it appears that there was no conversion of the measure into law by the National Congress, which is why the authorization for the conclusion of an individual agreement, prevailing over the law and collective instruments, it expired on July 19, 2020.

From this, considering the continuity of the economic crisis resulting from the social isolation measures, it is necessary to wait for the positioning of the Federal Senate, with the edition of a legislative decree, in order to verify how the validity of the labor provisions and alternatives created by the MP 927/2020.

Therefore, in the current scenario, it is considered safer for companies to seek the negotiation of specific conditions before professional unions, given that the collective agreement prevails over the law regardless of the validity of MP 927/2020, by force of art. 611-A of the CLT.

Finally, it is important to keep in mind that any agreement that will replace the law, although exceptional in the circumstances, must be managed for a determined time, while the public calamity situation remains, and must be duly justified and formalized by entering into a written agreement.
